RELEASE OF LIABILITY, WAIVER OF CLAIMS, ASSUMPTION OF RISKS, AND INDEMNITY AGREEMENT

(hereinafter referred to as the “Release Agreement”)

BY ACKNOWLEDGING THIS AGREEMENT ELECTRONICALLY, YOU WILL WAIVE OR GIVE UP CERTAIN LEGAL RIGHTS, INCLUDING THE RIGHT TO SUE OR CLAIM COMPENSATION FOLLOWING AN ACCIDENT.

PLEASE READ CAREFULLY AND SEEK LEGAL ADVICE IF NECESSARY.

TO: Richmond Hill Pickleball Club and its respective directors, officers, employees, instructors, agents, representatives, volunteers, independent contractors, subcontractors, sponsors, successors, and assigns (hereinafter collectively referred to as the “Releasees”).

ASSUMPTION OF RISKS

I acknowledge and understand that participating in the sport of pickleball involves many risks, dangers, and hazards, including but not limited to:

Collision with other persons or objects;

Being struck by a paddle or ball;

Risks of physical exertion, including stroke, heart attack, or other life-threatening conditions;

Personal injuries such as strains, sprains, fractures, brain injury, spinal cord injury (including paraplegia or quadriplegia), or death;

Loss of balance or control;

Slips, trips, or falls;

Negligent first aid or emergency treatment;

Negligence of other participants or Releasees; and

NEGLIGENCE ON THE PART OF THE RELEASEES, INCLUDING FAILURE TO TAKE REASONABLE STEPS TO SAFEGUARD OR PROTECT ME FROM THE RISKS, DANGERS, AND HAZARDS REFERRED TO ABOVE.

I FREELY ACCEPT AND FULLY ASSUME ALL SUCH RISKS, DANGERS, AND HAZARDS AND THE POSSIBILITY OF PERSONAL INJURY, DEATH, OR PROPERTY DAMAGE OR LOSS RESULTING THEREFROM.

RELEASE OF LIABILITY, WAIVER OF CLAIMS, AND INDEMNITY AGREEMENT

In consideration of the Releasees accepting my participation in pickleball programs, events, or activities, and permitting my use of their facilities and premises, I hereby agree as follows:

TO WAIVE ANY AND ALL CLAIMS that I have or may in the future have against THE RELEASEES, and TO RELEASE THE RELEASEES from any and all liability for any loss, damage, expense, or injury, including death, that I may suffer, or that my next of kin may suffer, as a result of my participation in pickleball activities, DUE TO ANY CAUSE WHATSOEVER, INCLUDING NEGLIGENCE, BREACH OF CONTRACT, OR BREACH OF ANY STATUTORY OR OTHER DUTY OF CARE OWED UNDER APPLICABLE LEGISLATION ON THE PART OF THE RELEASEES.

TO HOLD HARMLESS AND INDEMNIFY THE RELEASEES from any and all liability for any damage to property or personal injury to any third party resulting from my participation in pickleball activities or use of the premises.

This Release Agreement shall be effective and binding upon my heirs, next of kin, executors, administrators, assigns, and representatives in the event of my death or incapacity.

This Release Agreement and any rights, duties, and obligations as between the parties shall be governed by and interpreted solely in accordance with the laws of the Province of Ontario.

Any litigation involving the parties to this Release Agreement shall be brought solely within the Province of Ontario and shall be within the exclusive jurisdiction of the Courts of the Province of Ontario.

ELECTRONIC ACKNOWLEDGMENT

By completing my membership registration online and submitting my application, I confirm that:

I have read and understood this Release Agreement in its entirety.

I agree to all terms and conditions outlined in this Release Agreement.

My electronic acknowledgment serves as my legal consent to the terms herein, and I understand that it is as binding as my physical signature.

MEDICAL CONSENT

In the event of an injury or illness, I authorize the Releasees to obtain necessary medical treatment on my behalf. I understand that I am responsible for any costs associated with such treatment.

PHOTOGRAPHY AND MEDIA RELEASE

I grant the Releasees permission to take photographs or videos of me during activities and to use them for promotional or informational purposes, without compensation or further approval. I understand that this consent complies with applicable privacy laws in Ontario.

PARTICIPANT REPRESENTATIONS

I represent that I am physically fit and able to participate in pickleball activities.

I agree to follow all rules and guidelines set by the Releasees.

I acknowledge that failure to comply with these rules may result in my removal from the activity without refund.

FINAL ACKNOWLEDGMENT

By completing the registration process, I confirm my acceptance of the terms outlined in this Release Agreement and acknowledge that my participation is subject to these terms.
